What is a UK Sole Representative Visa?

The Sole Representative of an Overseas Business visa allows a senior employee of an overseas business to come to the UK to set up and run a UK branch or wholly-owned subsidiary of the overseas parent company.  Indefinite leave to remain (ILR) can be achieved after 5 years in the Representative of an Overseas Business visa category.

For an employee to qualify for a UK Overseas Business Representative visa, the parent company must be an active and trading overseas business.  The overseas parent company must have, and intend to continue to have, its headquarters and principal place of business outside the UK.  If the parent company already has a branch, subsidiary or other representative in the UK then the business will be excluded.  Even where there is no representative in the UK, the business will be disqualified if the employee setting up the branch or subsidiary in the UK would involve the business effectively moving the centre of its business operations to the UK. 

 

Initial Application

Once your Sole Representative Visa application has been approved, you’ll be eligible to enter the UK and stay to expand your business for 3 years after which you can extend your stay by submitting a leave to remain application

Extension

In order to qualify for an extension of stay as a Representative of an Overseas Business, you will need to still be working for the same employer in the UK.

Settlement

After five years in the UK as a Sole Representative of an Overseas Business, you may be eligible to apply for settlement.

Nationality

After six years, applicants can be eligible to apply for British nationality.

UK Sole Representative Visa Requirements

  • Applicants must be an employee and a representative of a company operating outside the UK which has no branch, subsidiary, or other representatives in the UK;
  • Applicants must be recruited and employed outside the UK;
  • Applicants must have extensive related industry experience and knowledge;
  • The applicant must be a senior employee with full authority to take an operational decision for setting up a branch in the UK or wholly-owned a subsidiary on behalf of the overseas company;
  • The applicant cannot be the majority shareholder in the company thus shareholding must be less than 50%;
  • The applicant must not take any other job;
  • The applicant must have enough money to maintain and accommodate themselves and their dependent/s (if any) without recourse to public funds; and
  • The applicant must meet the English Language Requirement.
  • The UK Sole Representative visa applicant will need to meet the English Language requirements at level A1 of the Common European Framework Reference (CEFR). This requirement can also be met if the applicant has a degree acceptable by UK NARIC.
